This agreement describes the terms and conditions for participation in the NHI affiliate program. In this agreement, the term "Affiliate" refers to you (“the joiner”). In this agreement, “NHI” refers to Nurtured Heart Institute, LLC., a Texas Limited Liability Company, with whom you are entering this agreement. By joining the NHI affiliate program you are confirming that you have read the agreement and agree to the terms and conditions.

There is only one type of affiliate program with NHI, specifically related to NHI’s Certified Training Intensives (CTI). This is not a cash paid program. Affiliate’s will only receive credits that can be applied to one NHI product, Certified Training Intensives (CTI’s). No payments will be made directly to the Affiliate. This is for currently certified trainers only; trainers with an active certification. 

1 Credit = $100 reduction for each individual CTI referral (if a group / agency is referred, each individual making up that group’s registration will = 1 Credit)

For a referral to generate a credit to an Affiliate, the individual or group must complete the CTI registration form, remit full payment for the CTI, and attend. Credits will only be issued for referrals AFTER the individual or group ATTENDS a CTI.

An Affiliate may accumulate credits for each paid transaction by the referral. 

An Affiliate can request any number of accumulated credits be applied to any future CTI but may only apply accumulated credits ONCE per CTI. 

Example: Affiliate has referred 5 people to a January CTI. All 5 people pay and attend (without any refunds being issued). Affiliate now has 5 Credits to apply to any upcoming CTI. 

The Affiliate may wait until right before their preferred choice of CTI to try and get more referrals, or they may apply the 5 credits, register, and pay the outstanding balance due. Let’s say the Affiliate registers for a May CTI as an Advanced Trainer and applies all 5 credits. ($999 - $500 = $499 due.) 

If the Affiliate has another referral AFTER registering and applying their accumulated credits to the May CTI, that referral would not be available for use for their May CTI. Meaning, no refund of the difference they paid would be made. That new referral however would be accumulated for future use on another CTI.

In the event a referral requests a refund for a transaction for which the Affiliate would otherwise earn a credit, the credit will no longer be valid for issuance. (Remember, a referral must register, pay, and attend a CTI for credit issuance.) 

Affiliates are permitted to reshare any of NHI’s public social media posts, website links, personal experiences with NHI or the Nurtured Heart Approach. 

The Affiliate will never imply that they are acting on behalf of NHI and will never advertise NHI CTI’s directly (as their own). 

The Affiliate will never represent themselves, NHI or their relationship with NHI in a false or misleading way.

The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing NHI.

Either party has the right to terminate the agreement immediately without prior notice.

If the Affiliate or NHI terminates the Agreement, no further credits from NHI will be accrued for any past or future referral transactions, and Affiliate forfeits all accumulated credits. 

This Agreement shall be governed, construed, and enforced in accordance with the laws of the State of Texas, without regard to its conflict of laws rules.

All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the State of Texas. An award of arbitration may be confirmed in a court of competent jurisdiction.

We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available credits, credit schedules, application of credits procedures and Affiliate Program rules.
